Terms and Conditions of Sale

1. Scope of application

These General Terms and Conditions of Sale, hereinafter "GTCS", apply to orders placed via the gokneeflex.com website.

By placing an order, the customer declares that they have read these GTCS and accepts the terms and conditions applicable at the time of purchase.

Any different terms proposed by the customer shall apply exclusively if expressly accepted by MAMITO LLC.

Our online store offers products under the Kneeflex brand. Each product is presented on its respective page with a description, images, and the main information available.

We do our best to represent the products as accurately as possible. However, slight differences may occur regarding, for example:

• colors and visual appearance based on the screen used;
• materials and finishes;
• dimensions and fit;
• packaging or minor product details;
• any production updates.

The images on the site are for illustrative purposes and may have slight differences compared to the delivered product.

In case of persistent pain, injury, pre-existing condition, or concerns regarding the use of a product, it is advisable to consult a healthcare professional.

4. Prices

The prices applicable are those indicated on the site at the time of the order.

Before final order confirmation, the customer can view the price of the products, any shipping costs, and the total amount.

We reserve the right to change prices, offers, discounts, and promotions at any time. Changes do not affect orders that have already been concluded.

5. Shipping costs

Any shipping costs are clearly indicated during the payment process, before order confirmation.

If a promotion providing free shipping is active, this condition is indicated on the site or during checkout.

6. Order and conclusion of contract

The presentation of products on our site constitutes an invitation for the customer to place an order.

The customer can select the desired products, add them to the cart, and verify the entered data before confirming the purchase.

By submitting the order, the customer submits a binding purchase request for the selected products.

After receiving the order, an automated email is normally sent confirming receipt.

The sales contract is considered concluded when the order is accepted, the goods are shipped, or the shipping confirmation is sent.

We may refuse or cancel an order, for example, when:

• a product is no longer available;
• payment cannot be authorized or verified;
• there is an obvious pricing or description error;
• there are reasonable grounds indicating fraud or abuse;
• delivery cannot be made to the indicated address.

If an order already paid is canceled by us, the amounts received will be refunded via the payment method originally used, where possible.

If cancellation is still possible and payment has already been made, the amount will be refunded via the payment method originally used, where possible.

Once the order has shipped, the customer may exercise, where applicable, the right of withdrawal or utilize the return policy provided by Kneeflex.

Payment is due at the time of order confirmation.

The available payment methods are shown during checkout and may include:

• credit or debit cards;
• Shopify Payments;
• PayPal;
• Klarna;
• Apple Pay;
• Google Pay;
• other methods possibly indicated at the time of payment.

Some payments are processed by external payment service providers and may be subject to their respective terms.

9. Delivery

Delivery is made to the address provided by the customer during the ordering process.

We currently deliver primarily in Italy. Any availability of other destinations is shown directly during checkout.

The indicated delivery times are estimates and may vary due to the courier, order volume, holidays, or other operational circumstances beyond our reasonable control.

The customer is required to verify that the delivery address provided is complete and correct.

10. Right of withdrawal

Consumers who make an online purchase have, in cases provided by law, a right of withdrawal.

To exercise the right of withdrawal, the customer must clearly communicate to us their decision to withdraw from the contract.

Any commercial warranties or voluntary return policies offered by Kneeflex do not limit the right of withdrawal provided by applicable law.

11. Voluntary return policy

In addition to the rights provided by law, Kneeflex currently offers a return possibility of up to 30 days, under the conditions indicated in our Return and Refund Policy.

The commercial return policy is distinct from the legal right of withdrawal and does not limit the mandatory rights of the consumer.

12. Condition of returned products

As part of the right of withdrawal, the consumer is responsible for any diminution in the value of the goods resulting from handling other than what is necessary to establish their nature, characteristics, and functioning.

For any returns made as part of our voluntary 30-day commercial policy, additional conditions may apply as indicated in the Return and Refund Policy.

Consumer rights regarding defective or non-conforming products remain unaffected in any case.

13. Legal warranty of conformity

The legal warranty protects the consumer if the purchased product has a lack of conformity, does not correspond to the description, does not possess the expected characteristics, or is different from what was ordered.

We recommend that you indicate the order number and, when useful, attach photographs or videos of the issue, to allow us to manage the request as quickly as possible.

Any commercial warranties, return policies, or "money-back" guarantees voluntarily offered by Kneeflex are in addition to the rights provided by the legal warranty and do not replace or limit them.

14. Liability

MAMITO LLC is liable within the limits provided by applicable law.

Nothing in these GTCS limits or excludes rights or forms of liability that cannot be limited or excluded under applicable law.

Furthermore, rights related to defective or non-conforming products and mandatory rules applicable to product liability remain unaffected.

15. Use of products

The customer is required to use the products according to their intended purpose and in compliance with any provided instructions.

To the extent permitted by law, MAMITO LLC cannot be held responsible for damages resulting from improper use, modification of the product, failure to follow instructions, or use contrary to the indications of a healthcare professional.

Kneeflex products do not replace the consultation, diagnosis, or treatment of a doctor.

17. Intellectual property

Unless otherwise indicated, texts, photographs, images, graphic elements, videos, logos, trade names, designs, and other content present on gokneeflex.com are protected by applicable intellectual property rights.

It is not permitted to reproduce, modify, distribute, or commercially use such content without prior authorization, except as permitted by law.

Reviews, photographs, videos, comments, or other content potentially transmitted by customers must not be unlawful, deceptive, offensive, or violate the rights of third parties.

We reserve the right not to publish or to remove unlawful, fraudulent, spam-like, or manifestly irrelevant content related to the products or services reviewed.

19. Promotions and discount codes

Promotions, discounts, and promotional codes are valid during the period and under the conditions potentially indicated in the relative offer.

Unless otherwise indicated, promotional codes cannot be applied retroactively to already completed orders.

We reserve the right to correct or cancel promotions affected by technical errors, fraudulent use, or obvious mistakes.

We may correct such errors. Should an obvious error affect an already placed order, we will contact the customer and, if necessary, proceed to cancel and refund the amounts already paid.

It is forbidden to use gokneeflex.com for activities that are illegal, fraudulent, abusive, or that could compromise the operation or security of the site.

• transmitting fraudulent or deceptive information;
• attempting to circumvent the site's security measures;
• distributing malware, viruses, or other harmful tools;
• illicitly collecting data relating to other users;
• engaging in spam or phishing activities;
• violating our intellectual property rights or those of third parties.

24. Applicable law and consumer protection

These GCS are governed by the law applicable to MAMITO LLC, without prejudice to the mandatory rights granted to consumers by the regulations of the country in which they have their habitual residence.

In particular, if the customer is a consumer residing in Italy, these conditions shall not have the effect of depriving them of the mandatory protections granted by the applicable Italian and European legislation for consumers.

This is without prejudice to any tools for out-of-court dispute resolution and remedies provided by applicable law.

26. Changes to these GCS

We may periodically update these General Conditions of Sale, for example, to adapt them to regulatory, operational, or service-related changes.

The updated version is published on gokneeflex.com.

Orders already placed are subject to the conditions in force at the time of order completion, unless otherwise provided by mandatory provisions.

27. Validity of provisions

Should a provision of these GCS be found invalid or ineffective, this does not affect the validity of the remaining provisions.

The affected provision shall be replaced or interpreted, where possible, in accordance with applicable law.
